IRB
IRB: The Immigration and Refugee Board of Canada is the largest independent administrative tribunal in Canada. IRB makes decisions on immigration and refugee matters in an effect and fair way ensuring that it falls well within the law. IRB is the ultimate deciding power to decide who is in need of refugee protection amongst the thousands of claims that are made to Canadian Immigration. IRB is further categorized into the following four divisions:
a) Refugee Protection Division: This division decides the claims for refugee claims that are made within Canada.
b) Refugee Appeals Division : This division considers the appeals against certain kind of decisions of Refugee Protection Division to allow or reject claims for refugee protection
c) Immigration Division: This division usually conducts immigration admissibility hearings who are believed to be inadmissible or removal from Canada, under the law and conducts detention reviews for those who are detained by Canada Border Services Agency (CBSA) under the Immigration and Refugee Protection Act (IRPA)
d) Immigration Appeal Division: This division generally hears the appeals of sponsorship applications that have been refused by the officials at Immigration Refugee and Citizenship Canada (IRCC), appeals from some removal orders that have been made against the Permanent Residents, refugee and other protected persons, holders of Permanent Resident Visas and appeals by the permanent residents who have been outside of Canada who have not fulfilled the obligation of their permanent residency. This also hears the appeals by the Canada Border Services Agency (CBSA) from decisions of the Immigration Division at admissibility hearings.
